INTRODUCTION

CKD Culinary Consulting, LLC, founded by Linda Blaylock, is a leading provider of personalized nutrition, dietary guidance, and culinary advice with a specialized focus on kidney disease. Through its comprehensive services—including the How to Eat for CKD Method™ Nutrition program, printed and online materials, educational resources, and social media support—CKD Culinary Consulting, LLC empowers individuals to better manage chronic kidney disease through practical, tailored solutions.

Linda Blaylock, the founder and creator of CKD Culinary Consulting, LLC, developed The How to Eat for CKD Method™ Nutrition program based on her extensive expertise and personal experience. The program and all related content, materials, and intellectual property are fully protected by copyrights and trademarks. CKD Culinary Consulting, LLC is a fully insured company, ensuring the highest standards of service and legal compliance. Everything associated with CKD Culinary Consulting, LLC—including its programs, names, and materials—is safeguarded under applicable intellectual property laws to protect the originality and integrity of the information provided.

INTERPRETATION AND DEFINITIONS

For the purposes of these Terms and Conditions, the following definitions apply. Whether in singular or plural form, the defined terms shall have the same meaning.


Definitions

"Account" refers to a unique account created for or by you to access our services or parts of our services. "Company" (referred to as either "the Company," "We," "Us," or "Our" in this Agreement) refers to CKD Culinary Consulting, LLC, and is inclusive of all related names, programs, or affiliates. (See the section on Other Names, Programs, or Abbreviations.) "Country" refers to the United States of America.

"Content" refers to any material made available through our services, including but not limited to content on websites, mobile or tablet applications, television platforms, PDAs, RSS feeds, streaming services, or other features. Content can include information, images, videos, live chats, posts, audio, webinars, and other forms of published, uploaded, linked, or printed material.

"Device" refers to any device capable of accessing our services, including but not limited to computers, mobile phones, tablets, or any emerging technology capable of accessing digital content.

"Feedback" refers to any feedback, comments, innovations, or suggestions provided by you regarding the features, performance, or attributes of our services or programs.

"Products" and "Programs" are used interchangeably and refer to any content, materials, or services offered for sale or for informational purposes through our websites, printed materials, or other platforms.

"Orders" refer to a request placed by you to purchase any programs, services, or products from us.

These names, programs, and abbreviations are exclusively owned by CKD Culinary Consulting, LLC and are fully protected by copyright, trademark, and other intellectual property laws.

Please read these terms and conditions carefully before accessing, using, or obtaining any programs, printed materials, or links to any information, images, products, videos, live chats, streaming content, posts, photographs, audio, discussion boards, webinars, or any other services made available by CKD Culinary Consulting, LLC. By accessing, using, or continuing to use any of the websites, mobile or tablet applications, television services, PDAs, RSS feeds, or any other features, platforms, or services (collectively referred to as "Our Website, Sites, or Site") owned or operated by CKD Culinary Consulting, LLC, you agree to be bound by these terms and conditions. This agreement applies to all forms of access and use, regardless of the device or platform used. These terms establish the rules for using our services and printed materials and outline what you can expect from CKD Culinary Consulting, LLC. They apply to everyone who accesses or uses our services or printed materials.

By continuing to use our services, you confirm that you have read, understood, and agree to abide by these rules.  

Age Requirement By using our services, you confirm that you are at least 18 years old. Our services are intended for use only by individuals aged 18 or older.

USER ACCOUNTS

When you sign up with us, please make sure the information you provide is accurate, complete, and up-to-date. If you don't follow these guidelines, your account may be terminated. You are responsible for keeping your password secure. If you think someone else might have access to your account, please let us know right away. You can't share your password with anyone else, or your account will be terminated, and you will lose any payments you've made. Please choose a username that is appropriate and not offensive.

CONTENT

Content Backups We frequently backup your data, but we can't promise that there won't be any loss or damage to it. Sometimes, the backups may not work properly due to the data being corrupted before being backed up or changing during the process. If you encounter any issues with your backups, please let us know and we will try to help you. However, we cannot be held responsible for the integrity of your data or its failure to be restored to a usable state. It's a good idea to keep a complete and accurate copy of your data in a location separate from our service.  

PLACING ORDERS FOR PROGRAMS, SERVICES, MEMBERSHIPS, OR PRODUCTS

By placing an Order through our Service, you warrant that you are legally capable of entering into binding contracts.   Your Information If you want to buy any of our programs, services, or products, we may ask you to give us some information to process your order. This information may include your name, email, phone number, credit card number, credit card expiration date, billing address, and shipping information.

By providing this information, you agree to let us share it with third-party payment processors to complete your order.

You promise that you have the right to use any credit or debit card or other payment method you use to place your order. You also promise that the information you give us is true, correct, and complete.  

Order Cancellation:

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to: ● Errors in Your Order ● Failed payment attempt ● Non-compliance of Terms, policies, rules, and poor conduct. We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.

AVAILABILITY, ERRORS, AND INACCURACIES

Sometimes, the information about our programs, services, and/or products on our website may be inaccurate, incomplete, or not up-to-date. We may also experience delays in updating this information on our website and other advertising sites. Therefore, we cannot guarantee the accuracy or completeness of any information regarding prices, program images, specifications, availability, and services. We reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice.  

PRICES POLICY

The Company reserves the right to revise its prices at any time.  Promotions & Discounts Any Promotions or discounts made available through the Service are governed by these same Terms.  

PAYMENTS & REFUNDS General Terms

·         Payment constitutes a contract between the buyer and CKD Culinary Consulting, LLC / How to Eat for CKD for access to online courses, books, members-only groups, classes, calls, or meetings.

·         Payment plans are available and will be enforced according to the terms outlined.

Payment Plans

·         Payment plans commence on the date of purchase.

·         Initial payment is charged upon enrollment, followed by installments every 30 days for the remaining 2-5 months, depending on the selected plan.

·         You may not cancel a payment plan after 30 days, or if you have logged into the online course or accessed members-only group content.

·         Payment plans may only be canceled within the first 30 days if you have not logged into the online course or accessed members-only group content.

Default and Legal Action

·         Failure to complete payments will result in legal action.

·         In case of default, you agree to pay a $500 fee in addition to the outstanding balance.

·         To return to the course (or group/class) after defaulting, full repayment of what you owe, the $500 fee, and re-purchase of the program in full at the current price is required; payment plans will not be accepted.

Payments Missed, Declined, or Stopped

·         If a payment is missed, declined, or stopped, your account will be placed on hold, and access will be suspended.

·         After 15 days of non-payment, full payment of the outstanding balance is required to avoid account closure.

·         Accounts unpaid after 30 days will result in legal action, including a $500 default fee and the remaining balance owed.

·         To return to the course (or group/class) after defaulting, full repayment of what you owe, the $500 fee, and re-purchase of the program in full at the current price is required; payment plans will not be accepted.

Refund Policy

·         Refunds are not available for any reason, including failure to log in, join, start, or complete the course. ·         The program “is not what I thought it would be,” "I'm too busy," or any other reason, as well as non-completion of the program or feeling you don’t have the time to complete it, is not grounds for a refund. ·         If you choose to leave the program, no refunds will be issued.

·         The first payment in a payment plan is non-refundable and serves as a cancellation fee if you withdraw.

·         Purchasing the book and enrolling in the online program are separate transactions. No refunds or reductions in online program fees will be provided.

·         If you are removed from the program or members group/classes for rule violations, no refunds will be issued, and immediate full payment of the plan is required (if applicable).

·         No refunds are given if you choose to leave or not use the members only support group / classes. ·         No refunds to Assistance calls missed, forgotten, or no showed. Payment is forfeit.

Online Program Access

·         Access begins on the day of purchase.

·         Access may be terminated for rule violations, abuse, or failure to maintain account standing.

·         Assistance calls are available unless access has been restricted due to abuse, excessive use, or account issues. Verification may be required for each call.

·         Sharing course materials or breaking confidentiality will result in legal action.

Members-Only CKD Group Hub Access

·         Access begins with payment and lasts one year from the date of purchase.

·         Membership renewals are due 365 days after the first payment.

·         Access may be revoked for rule violations, failure to renew, or account issues.

·         Sharing group materials or breaking confidentiality will result in legal action.

Assistance Calls

·         Assistance calls are available for a fee and consist of a 30-minute meeting via Zoom or phone.

·         Calls are available only to clients whose accounts are in good standing.

·         Verification may be required before scheduling if you purchase the book.

·         Availability is very limited; calls should only be used for essential 1:1 support or assistance.

·         Abuse or excessive use of calls, including excessive reschedules, no-shows, or cancellations, will result in restrictions or denial of access.

·         Actions will be determined on a case-by-case basis.

·         No refunds are available for any reason so please make sure you attend your call. Missed, forgotten, late, or no-show calls forfeit payment.

Other Notices

-By enrolling, you agree to these terms. If you do not agree, do not enroll.

-For cancellation requests, please contact us immediately.

-Payments can be made through online payment methods (e.g., PayPal, Stripe).

-Books may be purchased through Amazon or Barnes & Noble.

-Payment cards (credit or debit) are subject to validation checks and authorization by your card issuer.

-If authorization is not received, we are not liable for delays or non-access to programs.

-Clients experiencing financial hardship may request a pause in enrollment, but approval is rare and determined on a case-by-case basis.

-We are not liable for misprints, inaccuracies, or typographical errors.

-By accessing any website, content in any course, social media, email, video, verbal, or printed materials, you agree to the terms and conditions within this document.

-This agreement is legally binding, regardless of signature. If you disagree with any terms, notify us immediately to cancel your enrollment. Payment terms above will still apply.

REPRESENTATIONS AND WARRANTIES

Both parties confirm that they have the authority to enter into the agreement and that fulfilling their obligations under the agreement will not violate the rights of any third party or any other agreement, law, or regulation.  

APPLICABLE LAW: This agreement will be governed and construed in accordance with the laws of the State of Minnesota, USA.  

SEVERABILITY

If any part of these Terms is not valid or enforceable, it will be changed to the extent allowed by law, and the rest of the Terms will still apply.   WAIVER: If we don't enforce a particular rule or obligation outlined in this agreement, it doesn't mean we're giving up our right to do so in the future. And if there's a breach of this agreement, it doesn't mean we're waiving any subsequent breaches.  

ENTIRE AGREEMENT

Our Terms and legal notices are the complete agreement between you and CKD Culinary Consulting, LLC regarding the use of our websites or print materials. By using them, you agree to this Disclaimer. If you have any questions, please contact us.

This information is for home use only. No liability is assumed by CKD Culinary Consulting, LLC for this information, for any misuse, misdirection, or situations arising from what you do with this information. No guarantees may be created or extended by use of the materials within. Advice, strategies, suggestions, menus, methods, information, recipes, etc., may not be suitable for every situation. CKD Culinary Consulting offers no guarantee or undertaking and makes no representation of any kind that the program or products will meet Your requirements, achieve any intended results, be compatible or work with any other dietary needs. This work is offered with the understanding that CKD Culinary Consulting, LLC is not rendering medical, legal, or other professional advice or services. Seek professional services if needed. No guarantee to health or the slowing or halting of kidney disease is expressed.

PERSONAL RESPONSIBILITY

You are responsible for your own choices and actions when using our website. We aim to provide accurate information, but you should use your own judgment and research before implementing any idea, suggestion, or recommendation from our website. You accept full responsibility for the consequences of your use, or non-use, of any information provided on or through our websites and printed materials.  

CODE OF CONDUCT

When using CKD Culinary Consulting's websites, social media pages, emails, videos, images, printed materials, etc., you must not use them for any illegal or unauthorized purposes. You must comply with all local laws and not interfere with anyone else's use of the websites. You are responsible for your own conduct and must not post any inappropriate, abusive, or harmful content. CKD Culinary Consulting, LLC can remove individuals who violate these rules.

NO GUARANTEES

CKD Culinary Consulting, LLC is to support and assist you in reaching your own goals, but your success depends primarily on your own effort, motivation, commitment, and follow-through. CKD Culinary Consulting, LLC. cannot predict and does not guarantee that you will attain a particular result, and you accept and understand that results differ for everyone. Everyone’s results depend on his or her unique background, dedication, desire, motivation, actions, and numerous other factors. You fully agree that there are no guarantees as to the specific outcome or results you can expect from using the information you receive on or through this Website, social media, printed materials, videos, emails, or verbal, etc.  

INTELLECTUAL PROPERTY

Ownership and Protection of Intellectual Property

CKD Culinary Consulting, LLC and its licensors own the Service, its programs, original content, ideas, and methods as they are expressed through written materials, videos, guides, worksheets, and other media. This protection extends to the original expression of methods, ideas, and intellectual content from the program’s inception in 2020, including all prior and current versions. The methods, processes, techniques, and systems developed within the program are proprietary and confidential, and their expression through materials is protected under copyright law. The Service is protected by copyright, trademark, and other intellectual property laws. Both the original materials and all subsequent updates are protected under these terms. You cannot use, share, or apply our trademarks, trade dress, methods, or any content without our prior written consent. Any unauthorized use, reproduction, or application of program methods or content—including past and current materials—will be considered a violation of these terms and may result in legal action.

LICENSED USE

Clients who enroll in the program, purchase books, or obtain memberships are granted a limited, non-transferable license to use both the content and methods solely for personal application in managing CKD. This license applies to materials and methods created since 2020 and does not permit the sharing, application, or reproduction of the methods, processes, or intellectual content provided within the program for teaching, professional, or commercial purposes. Program materials may not be used to create derivative works or be shared in any form with non-members without prior written permission from CKD Culinary Consulting, LLC. Unauthorized sharing or application of program content or methods—including sharing online, teaching, or using them for professional purposes—constitutes a violation of these terms and may result in legal action.

CONFIDENTIALITY CLAUSE

All materials, discussions, and resources provided within our programs, services, or products—including those from prior versions—are strictly confidential and intended for private, home use only. Clients and professionals are bound by this confidentiality agreement upon purchase or enrollment. Both the program’s methods and intellectual content from 2020 onward are subject to this confidentiality requirement. These materials may not be shared, referred to, or mentioned outside the designated program or related social media groups. Violations of confidentiality will result in the following automatic damages:

$100,000 for general confidentiality violations.

$500,000 for confidentiality violations by professionals.

Violations include, but are not limited to:

Sharing program content or methods with non-members. Sharing content from the members-only group within the free non-client group. Distributing course materials or publicly posting discussions or content related to the program without permission. Applying the methods or techniques for teaching, professional services, or any purpose outside of personal use.

Failure to adhere to these terms may result in removal from the program or groups and legal action.

DAMAGES AND LEGAL REMEDIES

In the event of any unauthorized use, reproduction, or disclosure of the program’s methods or intellectual content—whether from earlier versions (2020) or current materials—you agree to compensatory damages of no less than $1 million USD for the first offense and $2 million USD for the second offense. The actual amount will be determined in accordance with applicable law to cover losses, legal fees, and associated costs incurred by CKD Culinary Consulting, LLC. As part of the legal remedy, you will be required to issue a public acknowledgment of the infringement and agree to immediately cease and desist all violations.

JURISDICTION AND GOVERNING LAW

This agreement will be governed by and construed in accordance with the laws of Minnesota, USA, and any disputes arising from these terms will be resolved exclusively in the courts of Minnesota, USA.

VIOLATIONS AND UNAUTHORIZED USE

Violations of these terms include, but are not limited to:

Reproducing or distributing any portion of program materials without permission. Sharing program content or methods with non-members. Using or applying program methods, processes, or suggestions from 2020 onward for teaching, professional, or commercial purposes. Using program materials to create derivative works. Publicly posting any part of the program or discussions without written consent.

Any individual who assists a client in working through program materials—whether a spouse, friend, family member, caregiver, or professional—or who accesses or shares program content or methods without permission, is bound by these terms and conditions. By participating in or benefiting from the program in any way, they are considered to have accepted these terms by association. This includes, but is not limited to, sharing content with non-members or gaining access to program materials without proper authorization. Those found in violation agree to compensatory damages as outlined and any other legal remedies pursued by CKD Culinary Consulting, LLC.

TERMINATION

We may terminate or suspend Your Account immediately or suspend or terminate, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately, you be removed from the community and client group(s) and/or program. See the Payment & Refunds section above for further information.

If You wish to terminate Your Account, you may simply discontinue using the Service, remove yourself from the Facebook group, and notify us. See the Payments & Refunds section above for further information.  

INDEMNIFICATION AND RELEASE OF CLAIMS

You hereby fully and completely hold harmless, indemnify, and release CKD Culinary Consulting, LLC. and any of its agents, consultants, affiliates, team members, joint venture partners, employees, shareholders, directors, staff, team members, or anyone otherwise affiliated with the business from any and all causes of action, allegations, suits, claims, damages, or demands whatsoever, in law or equity, that may arise in the past, present or future that is in any way related to our Websites, printed materials, or services.  

ERRORS AND OMISSIONS

CKD Culinary Consulting, LLC is a company that strives to provide accurate information to its clients. However, it is possible that the information shared may contain inadvertent inaccuracies or typographical errors. The company is not responsible for the views, opinions, or accuracy of facts referenced, or of those of any other individual or company affiliated with its business in any way. Due to constantly evolving scientific, technology, and business practices, it is also possible that errors or omissions may occur, for which CKD Culinary Consulting, LLC. cannot be held responsible. While all recipes supplied and nutritional information given are obtained using reputable sources and calculated using the NB20 program linked to the USDA, the accuracy of the information cannot be guaranteed. The recipes are not lab tested, and therefore, any mistypes, inaccuracies, or omissions can be brought to the attention of the company to remedy. Nutritional data may not always be available, and amounts are estimated based on the next best food or product or on the base ingredients used. CKD Culinary Consulting, LLC. makes every attempt to capture accurate information and will often contact the company requesting that information. However, as new food testing comes forward, this can alter the information previously supplied, so the company will update the information to the best of its ability. In summary, while CKD Culinary Consulting, LLC. is committed to providing accurate information, it cannot guarantee its accuracy and is not responsible for any errors or omissions that may occur.  

LIMITATION OF LIABILITY

The liability of CKD Culinary Consulting, LLC and its affiliates is limited to the amount actually paid by the user for services or products through the Service, or 0 USD if no purchase has been made. CKD Culinary Consulting, LLC shall not be liable for any special, incidental, indirect, or consequential damages arising out of or related to:

Third-party software, hardware, or services used in connection with the Service.

The Service is provided to you “AS IS” and “AS AVAILABLE” with all faults and defects, without any warranties or guarantees of any kind. CKD Culinary Consulting, LLC, on its own behalf and on behalf of its affiliates, licensors, and service providers, expressly disclaims any and all warranties, including but not limited to:

Express, implied, statutory warranties, or guarantees of merchantability.

Fitness for a particular purpose. Non-infringement.

Course of dealing, course of performance, or usage in trade.

In the event further legal action is required to enforce the arbitration decision, or if court proceedings are necessary due to jurisdictional requirements, you agree to be responsible for all legal fees, court costs, travel, and accommodation expenses for both parties.

Limitations on Liability and Settlement

Any settlement or damages awarded through mediation or arbitration are limited to the amount you paid for the program, product, or service. No claims will be considered or pursued beyond 1 year from the date of purchase. Any claims filed after this period will be considered waived and invalid.
