TERMS AND CONDITIONS ("TERMS") Our Terms and Conditions were last updated on 12/04/2025.  

Introduction

These Terms explain the conditions for using CKD Culinary Consulting, LLC programs, calculators, books, videos, groups, and services. They are written in clear language while remaining legally enforceable. By accessing any CKD material, you agree to these Terms.

Intellectual Property Notice

All CKD materials—including the CKD Nutritional Window Calculator (PDF and future app), the How to Eat for CKD Method Program, videos, PDFs, books, worksheets, group content, recipes, nutrient logic, teaching structure, steps, and all future updates—are exclusive property of CKD Culinary Consulting, LLC. Patent Pending. You may not copy, share, teach, publish, or recreate any CKD material without written permission.

Definitions

‘Company’ means CKD Culinary Consulting, LLC. ‘You’ means any user of CKD materials. ‘Content’ includes all materials, digital or printed. ‘Service’ means any program, calculator, group, course, or product. ‘Feedback’ refers to suggestions you provide and may be used freely.

User Accounts

You must provide accurate information and keep your password private. Accounts may be suspended for rule violations or misuse.

Content & Backups

We do not guarantee flawless backups. Keep your own copies of any data you enter.

Acknowledgment Section

Acknowledgment: By accessing any CKD program, calculator, group, membership, or material, you confirm you have read, understood, and agree to these Terms.

Placing Orders / Order Information

Placing Orders: By placing an order, you confirm you are legally able to enter a binding contract. You must provide accurate billing information. You authorize the Company to process payments through secure third-party providers.

Order Cancellation

Order Cancellation: The Company may cancel Orders at any time for reasons including errors, failed payments, or suspected fraud.

Availability, Errors, and Inaccuracies

Availability & Errors: Program descriptions, prices, and images may contain errors. The Company may correct inaccuracies at any time without notice.

Payments & Refunds – General Payment Terms

Payment is required to access any CKD Culinary Consulting, LLC program, course, calculator, book, membership, class, call, or digital product. Payment forms a binding contract. Payment plans are available and legally enforceable.

Payment Plans

Payment plans begin on enrollment. First payment is immediate. Additional payments occur every 30 days. You agree to complete all payments in full.

Payment Cancellations

You may not cancel  payments plan after 30 days or if you access the program or members group. Cancellation in the first 30 days is only allowed if you have not accessed any protected content.

Missed, Declined, or Stopped Payments

If a payment is missed or declined, your account is suspended, and a $50 administrative fee is added. If unresolved after 30 days, the account enters default, a $50 default fee applies, and the full remaining balance becomes due.

Legal Action for Non-Payment, Chargebacks, and Payment Interference Clause

If you access the program, members group, calculator, or any protected content, you agree that:

1.       Your payment plan becomes fully earned and non-cancelable.

2.       You must complete all remaining payments in your plan.

3.       Attempting to stop, reverse, or interfere with payments after accessing the program is considered breach of contract.

If you stop or interfere with required payments:

• Your account will be suspended immediately.
• A $50 administrative fee will be added for each failed or blocked payment attempt.
• After 30 days, your account enters default, and a $50 default fee will be added.
• The entire remaining balance of your payment plan becomes due at once (“acceleration”).
• You agree to pay all collection costs, attorney fees, and court costs required to recover the debt.

A deliberate chargeback or dispute filed with your bank is treated as fraudulent misrepresentation and a breach of the purchase agreement. You agree to reimburse CKD Culinary Consulting, LLC for all costs associated with contesting the dispute, including administrative fees and attorney fees.

Reinstatement Fee (Optional)

If your payment plan is disrupted due to missed or blocked payments, and you request reinstatement, a $150 reinstatement fee will be required in addition to all past-due amounts.

Refund Policy

Refunds are not offered for any reason, including lack of use, lack of time, dissatisfaction, or withdrawal. The first payment is non-refundable and acts as a cancellation fee. Purchasing the book is separate and non-refundable. No refunds for missed Assistance Calls.

Online Program Access

Access begins with purchase. Access may be suspended or terminated for rule violations, misuse, or unpaid balances. All program materials are for personal use only. Sharing is prohibited and may result in legal action.

Members-Only CKD Group Hub Access

Access may be revoked for rule violations, account issues, or non-payment. All discussions, screenshots, files, and posts in the group are confidential. Sharing group content is prohibited and subject to damages.

Assistance Calls

Assistance Calls are optional paid services. Calls last 30 minutes via Zoom or phone. No refunds for missed, late, or forgotten calls. Excessive rescheduling may result in loss of access.

Other Notices

By accessing any CKD program, calculator, book, group, email, video, or printed material, you agree to all Terms. We are not responsible for payment authorization failures or typographical errors. This agreement is binding regardless of signature.

Orders & Payments

Payment forms a binding contract. Payment plans must be completed. Refunds are not offered except where specifically stated.

CKD Numbers & Consult (if available)

These services provide educational nutrient targets only. Intake forms must be submitted on time. No refunds. Materials may not be shared.

Calculator Access

The calculator is currently offered as a PDF requiring Foxit Reader. Future updates or app versions may be provided. Refunds are allowed only if the PDF will not open in Foxit after troubleshooting and contacting for assistance.

Founders Group & Early Access Lifetime Pricing
Founders Group & Early Access: Founders Group members retain their original pricing for all calculator updates for life. Early Access members retain their pricing until the end of their subscription term.

Accuracy Disclaimer

Calculator results depend on your inputs. Errors may occur. Always verify numbers. We are not liable for inaccuracies.

Confidentiality

All program and group content is confidential. Sharing confidential content is prohibited.

Violations & Unauthorized Use
Unauthorized sharing, teaching, reproducing, or distributing CKD materials is prohibited and subject to liquidated damages.

Liquidated Damages Table

A. Unauthorized personal sharing: $50,000 per occurrence.
B. Amateur teaching or helping others bypass purchase: $150,000 per occurrence.
C. Professional or commercial use (coaches, dietitians, influencers): $500,000 per occurrence + disgorgement of profits.
D. Creating derivative works (programs, worksheets, calculators): $750,000 per occurrence + disgorgement of profits.
E. Posting CKD content publicly: $100,000 per occurrence.
F. Confidentiality violations follow the same tiers based on severity and professional involvement.

Liquidated Damages – Legal Paragraph

Any individual who assists another person in using CKD materials, whether spouse, friend, caregiver, nurse, dietitian, coach, or professional, is bound by these Terms. Assistance is treated according to the relevant damage category. These damages are pre-estimated amounts intended to fairly compensate the Company and deter misuse.

Licensed Use

You receive a limited license for personal use only. You may not teach, share, adapt, or commercialize CKD materials.

Code of Conduct

You may not post abusive content or interfere with other users. Violations may result in removal.

Personal Responsibility

You are responsible for your choices and actions when using CKD materials.

No Guarantees

We cannot guarantee results. Success depends on individual effort and circumstances.

Indemnification

You agree to hold the Company harmless against claims arising from misuse.

Limitation of Liability

Our liability is limited to the amount you paid, or zero if no payment was made.

As-Is Disclaimer

All materials are provided as-is without warranties.

Feedback

By submitting feedback, you grant the Company full rights to use it.

Cookies

Our websites use cookies. Disabling cookies may limit functionality.

License & Copyright

All website and program content is protected. You may not republish, sell, or reproduce materials.

User Comments

You may post comments but must ensure they are lawful. We may remove inappropriate comments.

EU Users

Entire Agreement

This document is the entire agreement between you and CKD Culinary Consulting, LLC.

Educational & Informational Use Only

All CKD programs and materials are provided for educational and informational purposes only and are not medical advice.

Dispute Resolution

Disputes must first go through informal resolution, then arbitration in Minnesota if needed. You are responsible for arbitration costs.

Jurisdiction & Governing Law

Jurisdiction: All disputes must be resolved in Minnesota courts or Minnesota-based arbitration.

Reservation of Rights

We reserve the right to remove links, refuse access, update terms, and modify or discontinue services at any time without notice.

Complaints & Communications

Contact us for concerns. We will attempt to resolve issues.

Terms Updates and Continued Use Clause

Terms Updates: CKD Culinary Consulting, LLC may update, revise, or replace these Terms at any time. Updated Terms apply to all past, current, and future users of any CKD program, course, calculator, group, membership, or product.

Continued Use:
By continuing to access any CKD material, program, or service after an update is posted, you agree to be bound by the most current version of the Terms, regardless of the date you originally enrolled or purchased.

Prior Terms:
All prior versions of the Terms are replaced by the most current version. If you do not agree to the updated Terms, you must discontinue use of all CKD materials and notify the Company. Payment obligations for past purchases remain enforceable under both prior and updated Terms.
